Terms of Service

Last updated: 5 October 2026 · Effective: 30 September 2026

These Terms of Service ("Terms") are a contract between you and Dovetail Ventures LLC ("MostlyHostly", "we", "us"), a Texas limited liability company and the operator of the website-hosting service at mostlyhostly.com and its subdomains (the "Service").

By creating an account, or by using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business, and "you" means that business.

Our Privacy Policy explains what personal information we collect and how we handle it, and forms part of your agreement with us.

1. What the Service is

MostlyHostly hosts small static websites — plain files and static-site generator output — for a limited group of customers. A typical site is a single page for a bar, café, or small business.

The Service includes:

  • Hosting — we serve your site over HTTPS at a *.mostlyhostly.site address and, optionally, at a custom domain you own.
  • A site builder — an onboarding wizard that uses an AI model to generate a first version of your site from information you provide, an in-app "describe a change" tool for later edits, and settings for common things such as your hours, menu, photos, social links, and languages.
  • A git repository — your site's files live in a repository we host; you can connect your own editor and push changes directly.
  • Optional add-ons and features — for example team access, online ordering, and event and sharing tools (section 9).

The Service does not include: server-side application hosting, databases, email mailboxes, content management systems, or payment processing for your own customers (the online-ordering add-on in section 9 records orders but does not take or hold payments), unless we have agreed otherwise with you in writing.

2. Eligibility and your account

  • You must be at least 18 and able to enter a contract.
  • One person is responsible for each account. Keep your password and any access tokens secret; you are responsible for everything done through your account.
  • Tell us promptly (hello@mostlyhostly.com) if you believe your account has been accessed without permission.
  • We may require a valid access code or invitation to register.
  • Confirm your email. We may ask you to confirm your email address before you can publish a site or use some features.
  • One account, honestly. Do not open several accounts, or repeatedly create and delete sites, to get extra free trials, AI credits, or other benefits. We limit how many sites and unpaid sites an account can have, and we may restrict, hold, or suspend an account whose activity looks like abuse — telling you why where we can.

3. Fees, free trial, and billing

  • Pricing: hosting is charged per site, per month, at the price shown when you subscribe. There are two hosting plans: Template (a site on our standard design) and Custom design (a design made for your site, by us or by you). Features included with hosting are the same on both plans; add-ons are priced separately and cost the same on either plan. Switching a site to a custom design moves it to the Custom design plan: a paid site is charged the difference for the rest of the current period, then the Custom design price. Switching back to the template moves it to the Template plan from the next billing period; the current period is not refunded. We may change prices for future billing periods on reasonable notice by email; a change does not affect a period you have already paid for.
  • Free trial: new sites are published on a free trial (currently 7 days; an invitation or partner code may give a different length). No card is needed to start. If you have not started a paid subscription when the trial ends, the site is taken offline (a placeholder page is shown) but its files and settings are kept for the grace period in section 8.
  • Subscriptions: paid plans renew automatically each period until cancelled. Fees are charged in advance and are non-refundable except where required by law. You can cancel at any time from the console. Cancelling takes effect at the end of the current paid period and stops future charges; it does not refund the current period. What happens to the site afterwards is set out in section 8.
  • Complimentary access: we may, at our discretion, give a site free or discounted access (a "comped" site), for a set period or with no end date — for example to a friend, partner, or early customer. Complimentary access has no cash value and is not a promise of free service beyond its stated end date; complimentary access with no end date may be ended by us with at least 30 days' notice by email. While it lasts, complimentary access includes our paid add-ons (section 9). A site that is not on a paid subscription when its complimentary period ends is treated like one whose trial has ended (section 8). Some complimentary sites are listed as customers — see section 4.
  • Sponsored sites: we may also host a site free of charge as a "sponsored" site, for a stated period or with no end date, in exchange for the site being listed as a customer (section 4) and keeping a "Built and hosted by MostlyHostly.com" credit in its footer, which cannot be turned off while the site is sponsored. A sponsorship covers hosting only; add-ons (section 9) are charged as usual. We may end a sponsorship with at least 30 days' notice by email; the site then continues on an ordinary free trial, and if it is not on a paid subscription when that ends it is treated like one whose trial has ended (section 8). A sponsorship has no cash value.
  • Credit packs: you may buy a one-time, non-recurring pack of extra AI credits. Purchased credits do not expire. A credit pack is refundable only if none of its credits have been used yet; once any credit from your purchased balance has been spent, the purchase is final and non-refundable. Purchased credits belong to your account, not to one site, so they stay with you if you delete a site and can be used on any of your sites. They cannot be transferred or exchanged for cash, and we may cap the balance an account can hold. This is separate from your plan's monthly allowance, which is never sold and never refunded.
  • Match fliers (packs and plan). Match fliers are the posters the console builds from league fixtures (section 9). A single flier is paid for with AI credits, at the amount shown before you make it. A season pack is a one-time purchase of a set number of fliers for a league and date range, priced per flier; it is refundable only if no flier has yet been made from it — a flier is a digital item made on demand, so once any has been made the purchase is final and non-refundable. The monthly flier plan is an add-on subscription that includes a monthly fair-use allowance of fliers (currently 40 per calendar month, counted in your venue's local time). It is not unlimited, unused fliers do not roll over, and we may change the allowance for future periods on reasonable notice. Cancelling the plan works like any other add-on: it ends at the close of the paid period and does not refund it.
  • Payment processing: payments are handled by Stripe. We do not store your card details. Stripe's terms and privacy policy also apply to the payment.
  • Taxes: stated prices exclude taxes unless we say otherwise; you are responsible for any taxes that apply to you. This clause is about what *we* charge *you*. Tax on what you sell through your own site — including anything sold through online ordering — is entirely yours to establish, charge, and pay; see section 9.
  • AI credits and allowances: the AI features run on credits. A new account gets a one-time starter allowance, and each paid site gets a monthly allowance that renews on the site's own billing anniversary and does not roll over. Different actions cost different amounts (building a whole site costs more than a small edit). When you run out, the AI features pause until your allowance renews or you buy a credit pack; the rest of your site keeps working.
  • Other usage limits: plans include reasonable limits on storage (per site), bandwidth, and build resources. If a site reaches its storage limit, actions that add content — uploads, AI edits, translations — pause until you free up space; publishing and serving your existing site are not affected. We may contact you about sustained heavy use.
  • Referral and partner rewards: if we run a referral or partner programme, discounts for the person referred and rewards for the referrer are promotional. Rewards are account credit with no cash value, are not transferable, are capped per person, and are granted only once the person referred has made the required paid invoices. We may withhold or reverse a reward for self-referral, duplicate or fake accounts, refunds or chargebacks, misleading promotion, or other abuse, and we may change or end a programme at any time without affecting rewards already granted.

4. Your content

  • You own your content. "Your content" means the text, images, logos, menus, code, and other material you upload, provide to the wizard, or push to your repository, plus the site built from it.
  • Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, build, transmit, and display your content for the purpose of operating the Service and your site. This licence ends when your content is deleted from the Service, except for copies in routine backups until they age out.
  • Publicity for paid and complimentary sites. Once a site of yours is on a paid subscription, you grant us a non-exclusive, royalty-free licence to use that site's business name, logo, and a screenshot of or link to the published site to identify you as a customer — for example in the customer list on mostlyhostly.com and in other marketing material. We will not suggest that you endorse anything beyond being a customer. This licence does not apply while a site is only on a free trial or is otherwise unpaid. Email hello@mostlyhostly.com if you would rather not be listed, or to have a listing removed, and we will remove it within a reasonable time. Complimentary sites. If we grant you a site free of charge as a complimentary plan (a "comped" site), the same licence applies for as long as the complimentary period lasts, and being listed is a condition of that plan — the opt-out in the console is switched off during that period. When the complimentary period ends, or once the site is on a paid subscription, the paragraph above applies as normal. If you would rather not be listed, email us and we will end the complimentary period (after which the site is treated like any other unpaid site) instead of listing you against your wishes. The same applies to sponsored sites (section 3).
  • Your responsibilities. You represent that you have all rights needed to use your content and to grant the licence above, and that your content and your site do not infringe anyone's rights or break any law.
  • Accuracy. You are responsible for the accuracy of what your site says — hours, prices, menus, claims about your business — including where an AI draft produced it.

5. Acceptable use

You must not use the Service to host, build, distribute, or link to:

  • anything illegal, or anything that promotes or facilitates illegal activity;
  • malware, phishing pages, credential-harvesting forms, or deceptive content;
  • spam, or infrastructure that supports spam or bulk unsolicited messaging;
  • cryptocurrency mining, proof-of-work, or other code whose purpose is to consume compute;
  • sexually explicit material, or content that sexualises minors;
  • content that harasses, threatens, defames, or incites violence or hatred against people based on who they are;
  • material that infringes copyright, trademark, or other rights;
  • another person's or business's identity, branding, or domain without authorisation.

You must also not:

  • run server-side code, background jobs, or services beyond serving static files;
  • probe, scan, or try to break the Service's security or isolation;
  • circumvent usage allowances, rate limits, screening, or access controls, including by opening new accounts or sites to get around a suspension, limit, or allowance;
  • resell or sublicense the Service, or host sites for third parties as a service, without our written agreement;
  • use the Service in a way that degrades it for other customers.

We run automated screening on every deploy. A build that trips the safety screen (non-static files, miners, committed secrets) is rejected. Pages that look like login forms, credential harvesting, or brand impersonation are flagged for review and may be taken offline immediately, including any custom domain pointed at them. We may suspend the account that published them.

To report abuse of a *.mostlyhostly.site address, use https://mostlyhostly.site/abuse/ or email abuse@mostlyhostly.com.

6. AI-generated content

  • AI drafts are provided "as is". They may contain errors, placeholder text, or design choices you do not want. Review a draft before you publish it.
  • You are responsible for the published result regardless of how it was created.
  • We do not guarantee that any two sites will look different, or that a style, layout, or wording is unique to you.
  • Translations and suggestions. The same applies to translations of your site, and to suggestions we produce from public web information when you ask (for example business details found online, or holiday-hours suggestions for your country). Translations are machine-generated and not checked by a person, and can go out of date when you change the original until you translate again. Suggestions may be wrong, out of date, or not apply to you — check them before you accept or rely on them. We do not apply a web-based suggestion to your site until you accept it.
  • The AI features depend on a third-party provider (currently OpenAI). The information you give the wizard and the edit tool — including any logo, photos, or menu files you upload to them — and the web searches it runs for you are sent to that provider to produce the output. Do not put confidential information into these tools.

7. Custom domains

  • If you connect a domain you own, you are responsible for keeping its registration and DNS current. We create the records needed to route and secure it while it is connected.
  • HTTPS certificates are issued by Let's Encrypt; connecting a domain means you accept their subscriber agreement for that domain.
  • If a connected domain stops pointing to us, or its registration lapses, the site remains reachable at its *.mostlyhostly.site address.

8. Suspension, termination, and offboarding

By you. You can delete a site, or close your whole account, at any time from the console. Deleting a site cancels any subscription for it (with no refund of the current period), takes it offline at once, and releases its web address. Everyone's access to the site ends, and any AI credits you bought stay with your account. What happens to the site's content is set out under "Grace period and data deletion" below: a site that was ever on a paid plan is kept for 180 days so you can restore it, and you can choose Delete everything now to skip that copy.

Closing your account. From the Account page you can close your account. Closing it cancels every subscription (with no refund of the current period) and treats every site you own as if you had deleted it: a site that was ever on a paid plan is kept for 180 days, a site that was only ever on the free trial is deleted. Team members lose access to the sites you owned, and you leave any team you were a member of. Your login stays for 180 days so you can sign in to restore a kept site or reopen the account; after that your login and personal details are permanently deleted (except records we must keep for legal, tax or dispute reasons). If you choose Delete everything now, your sites, files and account are deleted right away and nothing can be restored. Any purchased AI credits end with the account.

By us. We may suspend or terminate a site or account, with notice where practical and immediately where necessary, if:

  • you break these Terms, in particular section 5;
  • payment fails and is not resolved after we contact you;
  • we are required to by law or a valid legal request;
  • keeping the content online creates a security, legal, or reputational risk to the Service or other customers.

Grace period and data deletion. When a site goes offline, what happens next depends on how it went offline:

  • A free trial or complimentary period ends without a subscription, or we suspend a site for a serious violation: we keep its repository and settings for 14 days, during which re-subscribing or contacting us restores it. After that the repository, files, uploads, and traffic history are permanently deleted and cannot be recovered. A never-published draft with no activity is removed after 5 days.
  • You cancel a paid subscription (or payment lapses and is not resolved): the site stays instantly restorable on the same web address for 14 days. After that we archive a complete copy of the site and release its *.mostlyhostly.site address. We keep the archived copy for 180 days, during which you can restore the site by subscribing again and choosing a new address. We email you before the archived copy is deleted. After 180 days it is permanently deleted and cannot be recovered.
  • You delete a site that was ever on a paid plan, or close your account: the site goes offline at once and its *.mostlyhostly.site address is released. We keep a complete copy for 180 days, during which you can restore it by signing in, subscribing again and choosing a new address, and we email you before it is deleted. After 180 days it is permanently deleted. If you choose Delete everything now, no copy is kept. A site that was only ever on the free trial (and any draft) is deleted immediately, with no copy.

Immediate termination for a serious violation may skip these windows.

Export. Before deletion you can download your repository through the git access feature and export your traffic history from the console.

9. Add-ons and optional features

Some features are optional add-ons or are labelled Beta. Add-ons are priced separately and billed as their own subscription; cancelling one does not cancel your hosting. The first time a site subscribes to a paid add-on, the subscription may start with a free trial (currently 7 days): we take a payment card when you start it, charge nothing during the trial, and charge the monthly price when the trial ends unless you cancel before then. Cancelling during the trial costs nothing. One free trial per add-on per site. Anything you set up in an add-on is kept if the subscription ends, and comes back if you subscribe again. Beta features are provided as-is, and may change, be limited, be withdrawn, or become paid.

  • Team access. A site's owner can invite other people to work on it as a manager or an editor. Editors can change content; managers can also change settings and publish; only owners handle billing, the team, and deleting the site. A site includes a limited number of teammates; more may need an add-on. You are responsible for everything your teammates do on your site, and for removing anyone who should no longer have access. Teammates must follow these Terms.
  • Online ordering. If you turn on the online-ordering add-on, your site shows your menu, lets your customers place orders for pickup or delivery, and notifies you. You are the seller; we are not. We provide software only. We are not a party to the sale, and we are not a restaurant, marketplace, delivery service, payment processor, or merchant of record for anything you sell. The contract for each order is between you and your customer.
  • Online ordering — your money stays yours. Your order money never passes through us. Customers pay you in cash, by scanning a PromptPay QR code that credits your own account, or — where we support it — by card charged directly on your own Stripe account, which you open, control, and are the merchant of record on. In every case the money moves from your customer to you: we do not receive, hold, transfer, or route it, and we never take a commission, percentage, or any other share of a sale. Our charge for this feature is a flat monthly subscription that does not change with what you sell. For cash and PromptPay we also do not verify that payment happened — an order marked "paid" reflects what you or your customer reported.
  • Online ordering — tax is yours. If you enter a tax rate, a pickup charge, or a delivery charge, we perform the arithmetic you asked for and show the result to your customer. We do not determine, advise on, verify, collect, report, or remit any tax, and we do not check that a rate you enter is the correct one for your goods, your customer, or your location. Whether tax applies, at what rate, and to whom it must be paid is yours to establish, and any tax included in an order is money your customer paid you. Nothing we provide is tax or legal advice, and you should take your own.
  • Online ordering — everything else you are responsible for. Your prices and menu; licences and permits (including food handling and any rules on selling, delivering, or age-checking alcohol); the invoices or receipts your customers are entitled to and any tax or business registration number that must appear on them; preparing and delivering orders; refunds, chargebacks, and disputes; and complying with consumer-protection law. The delivery-range check compares the address a customer chooses with the area you set; it does not guarantee that an address is placed correctly on the map. Your customers' names, phone numbers, addresses, and payment-slip images are their personal information: use it only to fulfil and support their orders, and keep it secure. We store it to run the feature and show it to you and your team in the console. We are not liable for any loss between you and your customers, or for any tax, penalty, or interest arising from what you charge or fail to charge.
  • Online ordering — receipts and your customer list. A customer who gives an email address gets a receipt for their order, sent in your business's name. At checkout they can also tick an optional, unticked box to hear news and offers from you. Only people who ticked it appear on your Customers list, together with when they agreed and the wording they agreed to. Email them only about your own business, honour every unsubscribe (we do this for you on the list, but not for any copy you have exported), and do not sell, share, or hand the list to anyone else. You are responsible for complying with anti-spam and privacy law (such as CAN-SPAM, Thailand's PDPA, or the GDPR) when you contact them.
  • Contact form. If you turn on a site's contact form, visitors can send you a message that we email to an address you confirm. You must only use an inbox that is yours or that its owner has agreed to, and you are responsible for anything you do with a visitor's message and for treating their name, email address, and message as their personal information. We forward what a visitor types without checking who they are or what they say, we do not guarantee delivery (mail can be delayed, filtered, or bounced), and we keep a copy in the console for 30 days only. Do not rely on the form for anything urgent or safety-critical, and keep a phone number or email address on your site as well.
  • Bookings and Appointments. These are two paid add-ons, each billed separately from hosting and cancellable at the end of any billing month, and each free while your site is on its free trial. Bookings (tables, classes, rooms and spaces) is $15 a month per site. Appointments (with you or your staff) is $7 a month for each person guests can book an appointment with, at least one; adding a person charges the rest of that month on your next bill, removing one credits it, and the number you pay for follows the people switched on in your Appointments settings. Visitors can book times on your site and we confirm them automatically when a slot is free (or send you a request for larger groups, if you set that). You are responsible for honouring the bookings your site accepts, for keeping your booking hours, staff and rooms, blocked days and capacity accurate, and for treating visitors' names, emails and phone numbers as their personal information. We email confirmations and reminders on your behalf and try hard to prevent double bookings, but we do not guarantee delivery of any email or that every booking will be free of error — bookings you take elsewhere are not known to us unless you add them, or they appear as busy in a Google Calendar you have connected. If you take bookings as video calls, the call itself runs on Google Meet (made on your connected Google Calendar) or on the video service whose link you give us; we only pass the link to your confirmed guests and are not responsible for that service, the call, or who joins it — use its waiting-room or admit controls.
  • What's On. The fixtures-and-events list on your site is a paid add-on ($5 a month, billed separately from hosting and cancellable at the end of any billing month); it is free while your site is on its free trial. If the add-on lapses, your schedule stops being updated and is no longer shown by our widgets. You are responsible for the accuracy of the events you list, including any kick-off times we suggest for you to review.
  • Ask us (automatic answers). An "Ask a question" button on your site is a feature included free with every site, on every plan. We answer common visitor questions automatically from what your published site says (for example your opening hours, holiday hours, address, menu and prices, and whether you take online orders or bookings), and from answers you write. Anything we can't answer from those is sent to you, and your reply is saved and shown to later visitors who ask the same thing, including on a public FAQ page on your site. You are responsible for your answers being true and kept up to date. We never make up an answer, but an automatic answer is only as accurate as your site: if your site is wrong or out of date, the answer will be too. We ask you to re-confirm answers tied to a date (such as a holiday) before that date comes round again, and to review older answers now and then; an answer you have not confirmed may stop being shown. Visitors' questions — and an email address, if they choose to leave one to hear back — are their personal information; we keep them as our Privacy Policy describes.
  • Deposits. If you ask for a deposit, you are the seller: the guest pays you directly — by card on your own Stripe account, or by PromptPay to your own account — and MostlyHostly never holds the money or takes a cut. You set the amount (a fixed sum or a percentage of the price) and the refund rule shown to guests — how much of the deposit comes back if they cancel in time — and you are responsible for keeping it: card deposits cancelled inside your refund window are refunded automatically from your Stripe account for that amount, and PromptPay deposits you owe back are yours to return. If you cancel a booking yourself, the guest's whole deposit is refunded. Stripe keeps its processing fee on a refunded card payment; that cost is yours. A PromptPay payment is confirmed only when you mark it paid; we cannot see bank transfers. An unpaid deposit releases the time automatically.
  • Customer reviews. The reviews section shows quotes that you add. Only add reviews that are genuine, from real customers, quoted as they wrote them, and that you have the right to show. Do not write, buy, trade for, or alter reviews, and do not post reviews from people connected to you without saying so. We never write reviews for you — our AI tools are blocked from doing so — and we do not add markup that claims a star rating for you to search engines. The names of reviewers you publish are their personal information: take a review down promptly if its author asks. We may remove a review, or the section, that we believe is fake or misleading.
  • Events, fliers, and sharing (Beta). The events, flier, and broadcast tools help you draft posts and fliers and share them. We do not currently post to third-party social networks for you; when you share, you use those networks under their own rules. You are responsible for what you create and send, for having the rights to any photos or text you use, and for complying with advertising, anti-spam, and consent laws for any message you send to your own contacts.
  • Match fliers. If you follow a football league in the console, we show its fixtures and build posters for a game, a day, a week, or a season. Fixtures, kick-off times, and club names and crests come from third-party sources and are provided as-is: they can be late, incomplete, or wrong, and matches get moved, so check every date, time, and team before you publish or print a flier. We are not responsible for a flier that shows wrong information, or for anyone who acts on it. Club, league, and competition names, badges, and crests belong to their owners. We are not affiliated with any club, league, or broadcaster, and nothing we produce implies their endorsement. Before you can use crests, you must confirm that you are allowed to use club crests and names to promote your venue's football screenings, and that you take responsibility for that use. You are also responsible for making sure any showing you advertise is properly licensed where you are; public screenings usually need a licence or subscription of the right kind. We may remove a crest or club, or switch a league off, if we receive a complaint or a data provider withdraws the data. Days and weeks are counted on your venue's local calendar. Fliers you make are your content under sections 4 and 5.
  • Languages. You can offer your site in additional languages. Translations are machine-generated (section 6) and you are responsible for checking them. Our own legal pages are available in English only.
  • Footer credit and Manage shortcut. Sites built from our template include a small "Built with mostlyhostly.com" credit in the footer (paid sites can turn it off in Site settings; on a sponsored site it reads "Built and hosted by MostlyHostly.com" and stays on — section 3), and a "Manage" shortcut that stays hidden from visitors until a team member reveals it on their own device. The shortcut only links to the console sign-in; it does not give anyone access.

10. Third-party services and connected accounts

The Service is built on third-party providers for hosting, DNS and network security (Cloudflare), payments (Stripe), AI generation (OpenAI), HTTPS certificates (Let's Encrypt), email delivery, maps and address lookup, football fixture data (football-data.org — "Football data provided by the Football-Data.org API"), off-site backups, and — if you connect them — Google (Google Business Profile and Search Console). Data necessary to provide the Service passes through these providers, each under its own terms, and their availability affects ours. Our Privacy Policy describes what each category of provider receives.

Connected accounts and apps. Some optional features work by connecting an account or app you control: your Google Business Profile (to choose a few of your Google reviews to show on your site — once that connection is available), your Google account (so we can verify your site with Google Search Console and send it your sitemap), or an AI assistant such as Claude or ChatGPT (through our connector, so it can read, edit, and publish your site for you). When you connect one:

  • you authorise us — and, for an assistant, that assistant and its provider — to access or act as described in our Privacy Policy, and you confirm you are an owner or manager of the account and may grant that access;
  • anything a connected AI assistant does on your site counts as done by you: it is subject to sections 5 and 6, and you should review its changes before you publish. The assistant provider's own terms and privacy practices apply, including to the site content it can read;
  • your use of a connected account stays subject to the third party's own terms (for Google, the Google Terms of Service and the Google Business Profile additional terms), and we display data from it as that third party requires — for Google reviews, with attribution and without altering the review text;
  • you can disconnect at any time from the console (or in the provider's own settings), which ends our access going forward;
  • we are not responsible for the third-party service, its availability, or changes it makes to what it permits.

11. Backups

We take routine backups to help us recover the Service, but we do not guarantee they will be complete or current, and they are not a substitute for your own copy. Your site's files are in a git repository you can clone at any time — keep your own copy of anything you cannot afford to lose.

12. Service availability and changes

  • The Service is provided on a best-effort basis with no uptime guarantee and no service credits.
  • We may add, change, or remove features, and we may change these Terms. For material changes we will give notice by email to your account address before they take effect. Continuing to use the Service after that means you accept the change. If you do not accept it, stop using the Service and delete your sites.
  • We may discontinue the Service entirely on 60 days' notice, during which you can export your content.

13. Disclaimers

To the fullest extent allowed by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free. We do not warrant AI output, translations, web-based suggestions, address lookups or map positions, search-engine treatment of your site, orders or payments between you and your customers, or the conduct of any third party. Nothing in the Service is legal, tax, or accounting advice, and any tax figure it calculates is arithmetic on a rate you supplied (section 9).

14. Limitation of liability

To the fullest extent allowed by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
  • Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of the fees you paid us for the Service in the 3 months before the claim or USD 50.

Some jurisdictions do not allow certain limitations; in those, the limitations apply to the extent permitted.

15. Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your content, your site, your dealings with your own customers (including orders), anything done on your site by your teammates or connected assistants, your use of the Service, or your breach of these Terms.

16. General

  • Governing law and venue: these Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and disputes will be brought exclusively in the state or federal courts located in Texas.
  • Entire agreement: these Terms (with any plan-specific, add-on, or programme terms we give you, and our Privacy Policy) are the entire agreement between us about the Service.
  • No waiver: not enforcing a term is not a waiver of it.
  • Severability: if a term is unenforceable, the rest stays in effect.
  • Assignment: you may not assign these Terms; we may assign them to a successor of the Service.
  • Language: these Terms are in English; if we provide a translation, the English version governs.
  • Notices to you are sent to your account email; notices to us go to hello@mostlyhostly.com.

17. Consulting services

Separately from the Service, we offer hands-on help for a fee ("consulting"), for example: building your site for you; moving an existing website onto the Service; setting up your business to be found in local search; and connecting your AI assistant, setting up online ordering, and training you and your team. These Terms apply to consulting, with the additions below.

  • Quote first. Before any paid work starts we agree the scope and price in writing (email is enough). For a fixed-price package listed on our website, the listed price and what it says is included are the quote. Work outside the agreed scope needs a new or updated quote. We may decline any engagement.
  • Payment. We invoice through Stripe as the quote says. We may ask for some or all of the price up front. Consulting fees are separate from, and do not change, your hosting or add-on subscriptions.
  • Stopping early. Either of us can stop an engagement at any time with written notice. If we have not started, anything you paid for it is refunded. If we have, you pay for the work done up to that point, and we refund any prepaid amount beyond that.
  • What we need from you. Timely access, content, and answers. You must have the right to everything you give us to use, and you are responsible for the accounts, servers, registrars, payment providers, and other third-party services involved, including their fees and terms. We use any access you give us only for the agreed work. When we are done, you should remove our access and change any passwords or keys you shared.
  • Your systems and your backups. Before we work on anything outside the Service (for example, your own server or hosting account), you are responsible for making a current backup of it. We are not responsible for loss that a backup would have prevented.
  • Who owns the work. Once you have paid for it, the work made specifically for you (your content, configuration, and code written for your project) is yours. We keep our general know-how, tools, templates, and anything we made before or independently of the engagement; where any of it is part of what we deliver, you may use it for that project. Our site templates stay part of the Service.
  • Advice, not guarantees. Recommendations, reviews, and migrations are done with reasonable care, but we do not guarantee search rankings, traffic, sales, or that any system is secure or free of faults. A review is not a security certification, audit, or legal, tax, or accounting advice.
  • Confidentiality. We keep non-public information you share with us for an engagement confidential, and use it only for that engagement, unless the law requires otherwise.
  • Liability. Sections 13, 14, and 15 apply to consulting. For a consulting engagement, our total liability is limited to the fees you paid us for that engagement.
